GOSKETCH3D PTY. LTD. TERMS AND CONDITIONS 2016: These terms and conditions form a legal agreement between GOSKETCH3D.PTY.LTD (number 5864245) (GoSketch3D) and the user of its services ("You or Your"). These terms and conditions of business shall apply to all works that you request to be undertaken by GoSketch3D or You undertake on the website unless otherwise specifically agreed in writing.

By placing an order online You signify that You have read, understood and agree to be bound by these Terms and Conditions.

All orders and requests for works or any additional services will be subject to GoSketch3D acceptance which will be notified to You when GoSketch3D confirms the order and will be governed by these Terms and Conditions.

GoSketch3D reserves the right not to accept any request to undertake work placed by You and/or to cancel any work even after it has been accepted. GoSketch3D policy is that once an order has been placed it cannot be cancelled by You, a cancellation fee might incur.

All content provided by GoSketch3d, including designs, text, graphics, pictures, information, and other files are the property of GoSketch3D or third parties which license such rights to GoSketch3D.

No website architecture, nor any part of it, may be modified, copied, framed, distributed, scraped, posted, used or sold in any form or by any means.

GoSketch3D fees are payable by You from the point of order. Invoices will be issued at the beginning of each month for payment and should be payed on the date indicated on the corresponding invoice. Invoices that oustand 30 days will follow Section 8AAD of the Taxation Administration Act 1953.

You accept that any and all floor plans are intended for indicative purposes only and are not intended to be scale drawings. Measurements and areas quoted are approximate, whether or not a disclaimer appears on the drawing. It is Your responsibility to check all floor plans to ensure that they are correct in all requirements. On each job delivered You get 2 sets of amendments. If you wish to change anything reasonable in the floorplan, the 3rd time you request changes will incur in further charges. The changes or amendments should be sent via email. The best way to submit changes is by drawing the changes on the printed version of the floorplan, scanning it and then emailing them to floorplans@gosketch3d.com with the address of the property as the subject. The amendments will take up to 4 hrs to be reviewed and delivered back.

A cancelation fee of 50AUD will be charged if an appointment is cancelled in less than 24hrs. The turnaround time for each job is 24hrs.

GoSketch3D warrants that it will use reasonable skill and care to provide the Work. All other warranties express or implied are hereby excluded to the fullest extent permitted by law.

Any liability GoSketch3D may have (whether in contract, tort, including negligence or otherwise) shall be limited to the total fees paid by You under this agreement. GoSketch3D shall not be liable to You or to any third party for any loss of profits, loss of sales, loss of turnover or loss of use or corruption of data or software or for any indirect, consequential or special loss.

Nothing in these terms and conditions excludes GoSketch3D liability in respect of fraud or in respect of death or personal injury caused by GoSketch3D negligence.

GoSketch3D shall not be responsible for any delay or failure to carry out works for reasons beyond GoSketch3D reasonable control including but not limited to the acts or omissions of a third party or Your failure to perform Your obligations. In the event of a dispute about the quality of floor plans provided to YouGoSketch3D may at its sole discretion, elect to provide an additional floor plan or offer a full refund of any monies paid. You are solely responsible for making any and all back-up copies of the work. This section shall survive the termination of this agreement for any reason.

These terms and conditions form the only agreement between GoSketch3D and You. If a court decides that any part of these terms and conditions cannot be enforced, then that part will not apply.

The rest of these terms and conditions will continue to apply. Any notice given under these terms and conditions must be made in writing and sent by first class post to the parties' respective addresses.
